Tesla Sues Indian Company Over Trademark Infringement, Claims Consumer Confusion

Tesla Trademark Dispute in India

A Delhi High Court judge has issued a notice to Tesla Power, a Gurugram-based company, prohibiting them from using any promotional materials featuring EV products with a trademark resembling Tesla Inc. until the next hearing on May 22nd.

The American electric vehicle (EV) company, owned by Elon Musk, filed a complaint with the court alleging trademark infringement by Tesla Power. Tesla Inc. argued that Tesla Power's use of the "Tesla" trademark in India was creating confusion among consumers and negatively impacting their business. They also pointed out that consumer complaints regarding Tesla Power batteries were being directed to Tesla Inc., further solidifying the confusion.

Tesla Power, however, claims that they do not produce EV batteries and only sell lead-acid batteries for traditional vehicles and inverters. They also clarified that they have no intention of entering the EV market and that the advertisement in question was associated with another company, e-Ashwa, with whom they have a partnership for selling branded products.

The court noted that Tesla Inc. had not shown any urgency in the case and had been communicating with Tesla Power regarding the alleged unauthorized use of its trademark since 2020. The next hearing is scheduled for May 22nd, where the court will decide on the future course of action.
